Misuse or Misappropriation of Trust Assets in Arkansas

Submitted by Landon Reeves on Wed, Nov 27, 2024 - 18:37

The misuse or misappropriation of trust assets by a Trustee is not uncommon unfortunately. Too many Trustees succumb to the temptation to use trust assets to benefit themselves or their family members in violation of the terms of the Trust and in violation of Arkansas law. A violation by the Trustee of a duty owed to the Trust or beneficiaries may constitute a breach of trust whereby the Court has a laundry list of possible actions or remedies that it can take against the Trustee including the removal of the Trustee and forcing the Trustee to provide restitution to the Trust and its beneficiaries. This is a very common scenario that results in trust litigation in Arkansas.
